Buying or selling a home can be a very exciting time. It can also seem disconcerting when it comes to determining which things stay with the home and which things transfer to it’s new owner. What stays? What goes? Here are some helpful points to remember when it comes to things that will stay in the home and transfer ownership with the home being sold.

The Residential Resale Real Estate Purchase Contract states that the Seller agrees that all existing: fixtures on the Premises, personal property specified herein, and means to operate fixtures and property (i.e. – remote controls) shall convey in this sale. Including the following:

Inside of the Home:

  • Built-in appliances
  • Ceiling Fans & Remote Controls
  • Central Vacuum, hose, and attachments
  • Draperies and other window coverings
  • Fireplace equipment (affixed)
  • Free-standing range / oven
  • Garage door openers and remote controls
  • Light Fixtures
  • Stoves: gas-log, pellet, wood-burning
  • Timers (affixed)
  • Towel, curtain and drapery rods
  • Wall Mounted TV brackets and hardware (excluding TVs)
  • Shutters and awnings
  • Floor coverings (affixed)
  • Speakers (flush-mounted)

  Outside of the Home:

  • Mailbox
  • Media antennas / satellite dishes
  • Outdoor fountains and lighting
  • Outdoor landscaping (i.e. – shrubbery, trees and unpotted plants)
  • Storage Sheds
  • Storm Windows and Doors
  • Water-misting systems
  • Window and door screens, sun shades

*If in doubt, use the “tool rule”. If you need a tool to remove something, it stays.

If Owned by Seller:

  • Affixed alternate power systems serving the Premises (i.e. – solar)
  • In-ground pool and spa / hot tub equipment and covers (including any mechanical or other cleaning systems)
  • Security and / or fire systems and / or alarms
  • Water purification systems
  • Water softeners

 

There Are Some Things That Can Be Negotiable. For Example, a washer or dryer, fridge, or an above ground spa.

*If you are still in doubt, write it in the contract. Nothing is better than a written mutual agreement by all parties.
